Chemours Bitterant Patent Non-Assertion Pledge

Chemours announces a pledge to provide unconstrained access to its proprietary bitterant technology, used in aerosol dusters and other applications to discourage product misuse and inhalation. This decision reinforces Chemours commitment to safety and its vision, to deliver trusted chemistry, making lives better, and helping communities to thrive.

The proprietary bitterant technology is used with HFC-152a, a specialty chemical product, in a variety of applications, including personal care products and aerosol dusters.  The bitterant technology, U.S. Patent No. 7,754,096 (USPN ‘096), was developed and granted a patent for its ability to reduce the risk of HFC-152a containing products being improperly used or inhaled. Chemours pledges to not file a lawsuit or enforce USPN ‘096 against any person or entity that uses this bitterant technology to encourage adoption and safe use of the low global warming potential HFC-152a technology.  Chemours makes this pledge free of charge.  Free access to USPN ‘096 is provided without requiring pre-approval from Chemours and no contract is required.

Chemours intends this pledge to be legally binding and enforceable against Chemours.  However, except for USPN ‘096, no other rights, licenses, or obligations are undertaken, granted, received, or waived—whether by implication, estoppel, or otherwise. And Chemours provides no warranties of any kind regarding USPN ‘096, including whether any activities covered by this pledge are free from a claim of infringement by other persons or entities.
